1. Acceptance of Terms

By accessing or using any part of the Service, you confirm that you are at least 13 years of age, that you have read and understood these Terms, and that you agree to be bound by them. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of the Service

Hush is a focus and screen-time management tool composed of:

• Hush iOS App — software that enforces app restrictions using Apple's Screen Time framework, responds to Bluetooth beacon proximity and NFC card scans, and shows focus session history.
• Hush Beacon — a Bluetooth Low Energy device that signals the app when you are within range of a defined space (e.g., your desk or study room).
• Hush NFC Cards — programmable NFC tags that trigger focus mode when tapped with your iPhone.

The Service requires an iPhone running iOS 16.0 or later. Certain features require a Hush hardware purchase sold separately.

3. User Responsibilities

You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. Specifically, you agree not to:

• Reverse engineer, decompile, or disassemble any component of the Service
• Attempt to circumvent, disable, or interfere with any security feature of the app or hardware
• Use the Service in any way that could damage, overload, or impair the performance of our infrastructure
• Misrepresent your identity or affiliation in connection with the Service
• Resell, sublicense, or commercially exploit the app or hardware without our prior written consent

4. Intellectual Property

All software, design, text, graphics, and hardware designs associated with Hush are the property of Hush or its licensors and are protected by applicable intellectual property laws. These Terms do not grant you any rights to use our trademarks, logos, or brand features. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Hush app on devices you own or control, solely for your personal, non-commercial use, subject to these Terms.

5. In-App Purchases and Subscriptions

Some features of the Hush app may require a paid subscription or one-time purchase processed through the Apple App Store. All billing is handled by Apple and subject to Apple's payment terms. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions in your Apple ID account settings. We do not have access to your payment information.

6. Hardware Refund Policy

We offer a 30-day money-back guarantee on all Hush hardware purchases (Beacon and NFC Cards) made through our official store. If you are not satisfied for any reason within 30 days of receiving your order, contact us at support@hush.app with your order number and we will issue a full refund, including original shipping costs. Return shipping is at your expense unless the item is defective or we made an error. Refunds are issued to the original payment method within 5–10 business days of receiving the returned item.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Focus mode enforcement depends on iOS system APIs that may be affected by iOS updates, device restrictions, or user settings beyond our control.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HUSH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $50 USD.

9. Termination

We reserve the right to suspend or terminate your access to the Service at any time if you violate these Terms or engage in conduct that we determine is harmful to other users or to us. You may stop using the Service at any time by deleting the app and ceasing use of Hush hardware. Termination does not entitle you to a refund of any paid subscription fees already billed through the App Store, except as required by applicable law.

10. Modifications to Terms

We may revise these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you through an in-app notice. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the Service.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the United States.
